We will discuss the most recent action on disparate impact: "On October 26, upon consideration of the joint status report, the court entered a minute order continuing the stay until December 18, 2018 to allow HUD “to issue a Notice of Proposed Rulemaking in response to public comments.” The parties were also ordered to file another joint status report by December 18 “updating the Court on the status of HUD’s issuance of the rule and proposing any next steps in this litigation"

This program analyzes several important recent developments in Department of Housing and Urban Development (HUD) rulemaking and issuance of guidance based on disparate impact liability under the Fair Housing Act (FHA). The FHA, among other things, prohibits discrimination in the sale, rental, and conditions of housing because of an individual’s membership in one of the protected classes of race, color, religion, sex, familial status, national origin, or disability.
